1.1. This User Agreement governs the use of the website https://tks.law/ (the “Website”) and sets out the conditions for user access to materials, services, contact forms and other information available on the Website.
1.2. By using the Website, the User confirms that they have read, understood and fully accepted the terms of this Agreement without any reservations.
1.3. If the User does not agree with the terms of this Agreement, they must discontinue use of the Website.
1.4. This Agreement is publicly available and is posted on the Website for review by an unlimited number of users.
1.5. The Website is administered by TKS Disputes LLP or any other duly authorized entity.
2.1. “Website” means a set of web pages, software solutions, interfaces, texts, images, logos, design elements, files and other materials available on the Internet at https://tks.law/.
2.2. “User” means any individual or legal entity accessing and using the Website.
2.3. “Administration” means TKS Disputes LLP and/or other persons authorized to maintain, manage and administer the Website.
2.4. “Website Materials” means all content available on the Website, including texts, analytics, articles, reviews, images, graphics, logos, design elements, site structure and other intellectual property.
2.5. “Request” means any inquiry submitted by the User via website forms, messaging services, email, telephone or other communication channels listed on the Website.
3.1. This Agreement sets out the terms for the use of the Website, its materials and services.
3.2. The Website is provided for informational purposes and is intended for familiarization with the firm’s activities, obtaining information about its expertise, team, experience, publications and services, and submitting inquiries and requests for consultation or contact.
3.3. Information on the Website does not constitute legal advice, a legal opinion or a recommendation in relation to any specific matter unless expressly stated otherwise.
3.4. Use of the Website does not create a client–lawyer relationship or any contractual relationship between the User and TKS Disputes.
3.5. Such relationships arise only upon separate agreement and execution of appropriate engagement documents.
4.1. The User agrees to use the Website in good faith, reasonably and solely for lawful purposes.
4.2. The User is prohibited from using the Website in violation of the laws of the Republic of Kazakhstan, disrupting the operation of the Website, transmitting malicious software or automated tools, attempting unauthorized access to systems or data, copying or distributing Website Materials without prior written consent, or using contact forms for spam or misleading content.
4.3. The User must provide accurate information when submitting Requests.
4.4. The Administration may restrict access in case of violations.
5.1. Submission of a Request indicates an intention to establish contact only and does not constitute acceptance of an engagement.
5.2. The Administration may decline to respond, request additional information or refuse services where appropriate.
5.3. Information submitted prior to engagement is not automatically subject to legal privilege.
5.4. Users are advised not to submit sensitive information until secure communication is established.
All rights to the Website and its materials are owned by or lawfully used by TKS Disputes. Unauthorized use is prohibited.
Personal data is processed in accordance with applicable laws of the Republic of Kazakhstan.
The Website may use cookies and analytics tools to ensure functionality and improve performance.
9.1. The Website is provided “as is.”
9.2. The Administration shall not be liable for any losses arising from use of the Website, decisions based on Website information, third-party actions, external links or technical interruptions.
9.3. Website content is not a substitute for professional legal advice.
The Website may contain links to third-party resources. The Administration is not responsible for their content or reliability.
Information transmitted via the internet may not be fully secure. Secure channels may be agreed separately.
The Administration may amend this Agreement at any time. Continued use of the Website constitutes acceptance of updates.
13.1. This Agreement is governed by the laws of the Republic of Kazakhstan.
13.2. Disputes shall be resolved through negotiations.
13.3. Failing settlement, disputes shall be resolved in court.
14.1. Invalidity of any provision does not affect the remainder.
14.2. Failure to enforce rights does not constitute waiver.
14.3. The Russian version prevails unless otherwise specified.
